- Section A of State of Ga Code 2 – 1 – 6 states “No county, municipality, consolidated government, or other political subdivision of this state shall adopt or enforce any ordinance, rule, regulation, or resolution regulating crop management or animal husbandry practices involved in the production of agricultural or farm products on any private property. ” Thus, decibels be damned.
Bo Warren, Policy Director of the State of Georgia Department of Agriculture, confirmed my information as being accurate. He was also willing to speak with both City Manager Steve Krokoff and Police Chief Rich Austin to help clear the air. Being a “Milton Citizen”, I asked Steve and Rich to call Mr. Warren with my providing his contact information. Both refused but stated Mr. Warren was “more than welcome to call them… “

Unless our zoning is changed and sewer extended; freeing us to sell and move to an agriculturally knowledgeable, law abiding, and welcoming area, we will return to our legal practice of utilizing our radio to keep deer etc. away from our crops in 2023.
It is recommended that those given power advise the complainant, fire, and police of state and federal law moving forward as well as the “City” of Milton becoming knowledgeable on federal and state rules and regulations. Should any employee of said “City” come onto our property without permission, such will be considered “Illegal search, seizure and trespass” and will be reported to the State.
2.The Federal Right to Farm Act states “No agricultural facility, agricultural operation, any agricultural operation at an agricultural facility, agricultural support facility, or any operation at an agricultural support facility shall be or shall become a nuisance, either public or private, as a result of changed conditions in or around the locality of such facility or operation if the facility or operation has been in operation for one year or more.
